Cet amendement, qui entrera en vigueur le 1<sup>er<\/sup> janvier 2019, donne une plus grande libert\u00e9 contractuelle aux employeurs et salari\u00e9s en mati\u00e8re d\u2019options sur actions.<\/em><\/p>\n<p>La nouvelle loi ne s\u2019appliquera qu\u2019aux contrats pass\u00e9s et modifi\u00e9s apr\u00e8s le 1<sup>er<\/sup> janvier 2019. Elle abroge les restrictions en place, de sorte que l\u2019entreprise et le salari\u00e9 peuvent librement convenir des conditions d\u2019exercice des options qui n\u2019ont pas encore \u00e9t\u00e9 lev\u00e9es par le salari\u00e9 avant son licenciement. Il sera de plus possible de passer un accord permettant \u00e0 l\u2019entreprise de racheter les actions acquises par le salari\u00e9 dans le cas o\u00f9 celui-ci serait licenci\u00e9.<\/p>\n<p>Le changement apport\u00e9 \u00e0 la loi sur les options sur actions est li\u00e9 \u00e0 la proposition du Minist\u00e8re des finances de reformer les r\u00e8gles d\u2019imposition de l\u2019actionnariat salari\u00e9 et des stocks-options des salari\u00e9s. Cette proposition fera l\u2019objet de d\u00e9bats suppl\u00e9mentaires les 18 et 20 d\u00e9cembre 2018 et nous suivrons sa progression. Si elle est adopt\u00e9e, elle aura pour effet de renforcer l\u2019attractivit\u00e9 des nouvelles et petites entreprises pour les salari\u00e9s hautement qualifi\u00e9s.
